For Customers:

Contact Information: Email address (for verification and communication); phone number (optional, provided only when you request escalation to management); name (optional, provided when signing up for rewards or birthday programs)
Birthday Information: Birthday month and day (provided when you sign up for a business's Birthday Club program). We do not collect your birth year.
Complaint Content: Text descriptions of your issue, transcribed voice messages, and any images you upload (receipt photos, issue photos)
Communication History: Messages exchanged through our AI-powered chat system
Referral Information: Referral codes you generate, referral links you share, and the email addresses of friends you refer (used to track referral rewards and prevent duplicate referrals)

For Business Users:

Account Information: Business name, address, phone number, and email address
Team Member Information: Names, email addresses, and roles of staff members you add to your account
Payment Information: Billing details processed securely through our payment processor (we do not store full credit card numbers)
Business Customization: Logo, branding colors, review URLs, and operational settings

Device Information: Device type, operating system, and device fingerprint (a unique identifier generated from your device characteristics for fraud prevention purposes)

When you use voice input to describe your complaint, your audio is temporarily processed for transcription. The audio itself is not stored by GoodAgain. Only the resulting text transcription is saved as part of your complaint record.

4. How We Share Your Information

4.1 With Businesses (for Customers)

When you submit a complaint to a business through GoodAgain, we share your email address, complaint description, any uploaded images, resolution status, and promo codes issued to you. Your phone number is shared only if you provide it during escalation. Your complaint information is only shared with the specific business you filed the complaint with.

4.2 With Service Providers

We share data with trusted third-party service providers who assist us in operating our Service, including providers of database hosting, payment processing, email delivery, AI-powered responses, error tracking, subscription management, web hosting, QR code generation, and workplace messaging delivery for Live Alert notifications (Slack).

4.3 With Advertising Partners

We share limited information with advertising platforms to measure ad effectiveness. These platforms receive device identifiers, usage data, and conversion events but do not receive your complaint content or personal communications.

4.4 Legal Requirements

We may disclose your information if required by law or in good faith belief that such action is necessary to comply with legal obligations, protect our rights, prevent wrongdoing, or protect public safety.

5. Data Retention

Complaint Records: Retained for 2 years after resolution, then anonymized
Inactive Customer Records: Deleted after 1 year of inactivity
Promo Codes: Expired promo codes may be deleted by businesses after 90 days
Birthday Data: Retained for as long as the associated business account is active
Referral Data: Referral codes and referral relationships are retained for as long as the associated business account is active
Promotional Game Data: Scratch-to-win and spin-to-win participation records (including device identifiers and email) are retained to enforce eligibility limits and for as long as the associated business account is active
Business Account Information: Retained for subscription duration and 30 days after closure
Payment Records: Retained as required by law (typically 7 years)

6. Your Rights and Choices

Access and Portability: You may request a copy of your personal information. Businesses can export data through Settings.
Correction: You may update your account information or request correction of inaccurate data.
Deletion: You may request deletion of your account and personal data by contacting us.

Marketing Opt-Out:

Win-Back Emails: Businesses can disable win-back campaigns in their dashboard settings
Birthday Reward Emails: Businesses can disable the Birthday Club feature in their dashboard settings
Review Prompt Emails: Businesses can disable review prompts in their dashboard settings
Referral Reward Emails: Businesses can disable the referral program in their dashboard settings
Newsletter/Flyer Emails: Customers can unsubscribe via the link included in each newsletter
All Marketing Emails: Contact the business directly or email us at privacy@goodagain.ai to opt out

You will continue to receive transactional emails (such as promo code delivery and account notifications) even if you opt out of marketing emails.

7. California Privacy Rights (CCPA)

California residents have rights under the CCPA including the right to know what personal information we collect, the right to delete personal information, the right to opt-out of sale (we do not sell your personal information in the traditional sense), and the right to non-discrimination. 8. Data Security

We implement industry-standard security measures including encryption in transit (TLS/SSL), encryption at rest, role-based access controls, automated fraud detection, and PII redaction from error logs. However, no method of transmission over the Internet is 100% secure.

9. SMS/Text Message Communications

9.1 Information We Collect

When you opt in to receive SMS notifications from GoodAgain, we collect the following information:

Your mobile phone number
Your SMS consent status and the date consent was provided
Records of SMS messages sent to and received from your number
Your opt-in and opt-out history

9.2 How We Use Your Information

We use your phone number and related data solely to:

Send you transactional SMS alerts when customers submit issues at your business
Send you reminders about unresolved customer issues
Deliver opt-in confirmation and opt-out acknowledgment messages
Respond to HELP and STOP keyword requests

9.3 No Sharing or Selling of Mobile Opt-In Data

We do not share, sell, rent, or disclose your phone number, SMS opt-in data, or any mobile-related information to any third parties for their marketing or promotional purposes. Your mobile opt-in data and consent information will not be shared with or sold to third parties or affiliates for their own marketing or promotional use. Your phone number is shared only with our SMS service provider solely for the purpose of delivering messages on our behalf, and they are contractually prohibited from using your information for any other purpose.

9.4 Data Retention

We retain your phone number and consent records for as long as your account is active and you remain opted in to SMS notifications. If you opt out by replying STOP or through your account settings, we will retain a record of your opt-out request to ensure we honor it. Message logs are retained for a period of 90 days for troubleshooting and compliance purposes, after which they are deleted.

9.5 Data Security

We implement reasonable administrative, technical, and physical safeguards to protect your phone number and SMS-related data from unauthorized access, disclosure, alteration, or destruction.

10. Children's Privacy

Our Service is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13.
